In a letter today formally notifying Turner of the proposed termination, Richard Kunz, SCC Senior Director of Construction Operations, cited Turner's failure to perform work in accordance with its contract. Kunz said Turner's failures include its refusal to carry out the SCC order to comply with directives of the DEP.
The SCC, in a series of letters, repeatedly instructed Turner to indicate its intention to comply with SCC and DEP directives. Kunz said Turner now has 10 days to notify the SCC whether it intends to comply; if it does not do so, SCC would terminate its contract.
"Turner has not been a responsible partner at this school site," said Scott Weiner, Transitional CEO of the SCC. "We have repeatedly asked Turner to indicate with a simple 'yes' or 'no' on whether it intends to comply with its contractual obligations. The community, and particularly the students who need this new school, have been ill-served by Turner's actions.
"If necessary," Weiner added, "we are prepared to expeditiously move on with a new contractor who will finish the job."
